Terms of Service

1. Agreement to Terms

By creating an account, requesting or purchasing a CircleSFR chart, downloading CircleSFR software, or otherwise using CircleSFR, you agree to these Terms of Service. CircleSFR is operated by Gramm Inc., a Delaware corporation. If you use CircleSFR on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

CircleSFR provides printed camera sharpness test charts, downloadable SFR/MTF analysis software, related documentation, and support. The current product is a chart-and-software workflow for measuring spatial frequency response from captured chart images.

Public pages may describe planned chart fulfillment, pricing, software releases, checksums, or platform builds before those materials are uploaded. Items marked pending are not guaranteed to be available until the relevant checkout, download, or support process is live.

3. Accounts

• You must provide accurate account and organization information.
• You are responsible for activity under your account.
• Keep passwords, download links, and account access confidential.
• We may suspend or terminate accounts that violate these Terms or create security risk.

4. Chart Orders and Fulfillment

• Chart dimensions, print process, mounting options, availability, lead times, and pricing may change before checkout is enabled.
• Printed charts may have manufacturing tolerances, handling marks, or color variation that do not materially prevent normal chart use.
• You are responsible for selecting a chart size suitable for your camera resolution, working distance, framing, and lab setup.
• Shipping, taxes, customs, and return terms will be shown or confirmed during the applicable ordering process.
• Custom chart orders, if offered, may be non-refundable once production begins.

5. Software License

Subject to these Terms, Gramm Inc. grants you a limited, non-exclusive, non-transferable license to install and use CircleSFR software for internal camera testing, lab evaluation, quality workflows, and related reporting. Unless a separate written license says otherwise, you may not resell, sublicense, host, redistribute, or provide the software as a managed service for third parties.

• Do not reverse-engineer, decompile, or attempt to extract proprietary source code except where law expressly permits.
• Do not remove notices, trademarks, checksums, license files, or attribution included with releases.
• Do not use CircleSFR software to build a competing chart analysis product without a separate written agreement.
• Software may include open source components governed by their own license terms.

6. Measurement and Standards Disclaimer

CIRCLESFR IS PROVIDED FOR CAMERA SHARPNESS TESTING AND SFR/MTF ANALYSIS. MEASUREMENT RESULTS DEPEND ON CHART PRINT QUALITY, FLATNESS, LIGHTING, ALIGNMENT, FOCUS, EXPOSURE, CAMERA PROCESSING, DISTORTION, SOFTWARE SETTINGS, AND USER PROCEDURE.

REFERENCES TO ISO 12233 OR RELATED SFR METHODS DESCRIBE AN ISO-INFORMED WORKFLOW AND DO NOT, BY THEMSELVES, REPRESENT CERTIFICATION, ACCREDITATION, OR FULL CONFORMANCE OF ANY PARTICULAR CHART, RELEASE, LAB SETUP, OR CUSTOMER RESULT.

YOU ARE RESPONSIBLE FOR INDEPENDENT VERIFICATION BEFORE USING RESULTS FOR PROCUREMENT, CUSTOMER ACCEPTANCE, SAFETY-CRITICAL DECISIONS, REGULATORY SUBMISSIONS, OR WARRANTY CLAIMS.

7. Billing and Payments

• Payments, when enabled, may be processed by Stripe or another payment processor.
• Fees are shown before purchase and are non-refundable except where required by law or stated in writing.
• You are responsible for applicable taxes, duties, customs charges, and shipping fees.
• We may update pricing, packaging, and release access with reasonable notice where practical.

8. Intellectual Property and Trademark

CircleSFR, CircleSFR chart artwork, software, documentation, site content, logos, and related materials are owned by Gramm Inc. or its licensors. CircleSFR is a trademarked Gramm.ai business area. These Terms do not transfer ownership of any intellectual property to you.

You may use output files and reports generated from your own test images for internal evaluation and customer reporting, subject to these Terms and any separate license agreement.

11. Indemnification

You agree to defend, indemnify, and hold harmless Gramm Inc., its officers, directors, employees, and agents from third-party claims arising out of your misuse of CircleSFR, violation of these Terms, violation of law, or use of charts, software, reports, or results in a way that causes harm to another party.

12. Termination

• You may stop using CircleSFR at any time.
• We may suspend or terminate access for Terms violations, non-payment, security risk, or unlawful use.
• On termination, your license to use restricted software releases and account services ends.
• Sections on intellectual property, disclaimers, liability, indemnification, privacy, and dispute resolution survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page or sent by email when practical. Continued use of CircleSFR after an updated effective date constitutes acceptance of the updated Terms.

15. Feedback

If you send suggestions, bug reports, chart observations, feature requests, measurements, or other feedback, you grant Gramm Inc. a perpetual, worldwide, irrevocable, royalty-free license to use and incorporate that feedback into CircleSFR or related products without obligation, attribution, or compensation.

What We Collect

• Account data: email, name, organization, login state, and support preferences.
• Order data: chart size, shipping details, fulfillment status, invoices, and payment processor references.
• Download data: release requested, platform, timestamp, checksum access, and error logs.
• Support data: messages, attachments you provide, capture guidance requests, and troubleshooting context.
• Technical data: IP address, browser type, device information, security logs, and session cookies.
• Payment data: processed by Stripe or another processor. We do not store your full card number.

How We Use Data

• Provide accounts, chart ordering, software access, support, and security.
• Process payments, taxes, shipping, invoices, refunds, and fulfillment.
• Send transactional email for account, order, support, release, and billing events.
• Improve chart documentation, release quality, compatibility, and support workflows.

We do not sell your personal data or share it with advertisers.

Data Storage and Security

• Account and order records are stored with access controls appropriate to the service stage.
• Payment details are handled by the payment processor and subject to its security controls.
• We use commercially reasonable safeguards for authentication, transport security, logging, and access review.
• No internet service can guarantee absolute security.

Data Retention

• Account data is retained while your account is active.
• Order, payment, tax, and fulfillment records are retained as required for business, tax, warranty, and compliance purposes.
• Support records are retained as needed to resolve issues and improve documentation.
• Download and security logs may be retained for fraud prevention, abuse prevention, and release diagnostics.

Your Rights

• Request access to personal data associated with your account.
• Request correction of inaccurate account or order information.
• Request deletion where deletion is not inconsistent with legal, security, fulfillment, or accounting obligations.
• Request export of account and order information in a reasonable format.

Cookies

We use essential cookies for authentication, account security, session state, and checkout flow. We do not use third-party advertising cookies on CircleSFR public pages.

U.S. Resident Privacy Rights

CircleSFR has not sold or shared personal information for cross-context behavioral advertising in the preceding 12 months. U.S. residents may request disclosure, correction, deletion, or portability of personal information by emailing rex@circlesfr.com. We will respond as required by applicable law.

Children's Privacy

CircleSFR is not directed to individuals under 18. We do not knowingly collect personal information from minors. If we learn that a minor provided personal information, we will delete it where legally required.
